Terms of Service

*By purchasing/booking our services, you acknowledge that you have read, understood,

and agreed to all terms outlined in this Terms of Service listed below 

 

1. Services Provided

We provide notary public services including the notarization of documents as per the laws of The State of Ohio  & the State of Michigan.

2. Eligibility

You must be 18 years or older to access or use our services. By using our site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding contracts.

3. Charges, Payments, Cancellation, No Refund policies: 

Our notary services are subject to a fee(s), which will be clearly outlined at the time of booking & payment.

 

A. Charges: Per the State of Michigan, each in person notarial stamp is $10.00. State of Ohio $5.00 per notarial stamp in person. Fees for services are clearly outlined at time of booking. Travel fees are dependent on type of document to be notarized, witnesses, rush/emergency fees (2 hours or less notice) additional signers, distance from notary, as well as where, when and what type of facility is requested. Additional charges can include and not limited to tolls, parking fees, courier/drop fees, shipping, postage, copy, print, scan, fax, mileage, additional witness(es) we provide, after hours fees (5:00 pm 8:00 pm weekdays), overnight fees (8:00 pm - 9:00 am weekdays), holiday, holiday weekend, wait charges $25.00 per 15 minute increment past initial appointment time, fingerprinting, BCI check, apostille, authentication, translation, Secretary of State fees & credit card fee is $5.00.

 

B. Payments:  All services are prepaid : Cash - Motor Vehicle Titles only - Credit/Debit Cards: Master Card, Visa, Discover, American Express or PayPal, Google Pay, Apple Pay, Affirm & After pay, via our website. Notarial travel and/or any other charge fees listed in our Terms of service. Payments are due in full at the time of booking, before the provision of any services. Our notaries do not carry cash/change, no checks accepted at this time.

 

C. Cancellation Policy: As a Professional Notary Public we do our best to work on your schedule, when you need our services. We schedule our notaries for a minimum of 1- or more hours or more for general notary work for each client. Once you book & purchase an appointment with us and we confirm your appointment, there is a no-refund policy if you cancel less than 24 hours of the appointment.​​ If you cancel or reschedule less than 24 hours of your scheduled appointment you will charged the full total amount of the service. This is non refundable or transferable.  Our mobile notaries keep a very strict schedule. Purchasers understand that an on-time appointment is allowed only 15 minutes grace before the appointment is considered canceled. This does include signers or signer provided credible witnesses who refuse are unable or have invalid ID, to sign within 15 minutes of the appointment start time.  All signers must have proper identification for a notarial act to be performed. This includes: Unexpired Driver's License, State Issued Identification or United States Passport. No photograph or copies of ID are permitted. We understand situations change and emergencies happen, however, we are a business and when you book with us and then cancel last minute, then we are unable to take care of other clients because we reserved that time slot for you. It is the same as booking at any other professional business. Thank you for understanding!

 

​If we happen to make a mistake that needs to be fixed on the Notary Certificate, (IE: no notary signature, date & notarial seal/stamp). We will certainly do whatever we need to do fix our notarial error, free of any charge. If there is an instance where our notary is unable to come to your prescheduled appointment such as: Medical Emergency Sickness on our part, Car accident, Sudden family emergency, we will call you to reschedule the appointment no additional charge. 

 

​D. No Refund Policy 

Sharp Seal Notary LLC,  is an all sales and services provided by are final and non-refundable non-transferable policy company & will not be provided. ​​Sharp Seal Mobile Notary LLC, and any/all persons working for/with any persons contracted with/for or connected with or to. This policy applies to all aspects of our service offerings, including but not limited to: and any/all other fees and services & products we offer. All orders by Sharp Seal Notary  LLC and/or their representatives are based on availability.  General notary services are provided at an agreed upon fee prior to booking.  The customer entering in their card information is at liberty not to accept the fee posted. All signings are non-refundable unless canceled in writing via email to SharpSeal@proton.me 24 hours prior to the requested appointment time. By agreeing to these terms and agreements it will be presented to your card provider or Payor provider in case of a chargeback. Payees also agree to pay all fees related to chargeback disputes.  Services will not be assigned or rendered unless payment has been made in advance. Your booking will include the State Minimum Charge Per Notarization, Travel Fee, and administrative fees and/or credit card processing fees 4%.

4. Information Collected

To access and use our services, you may be required to provide certain personal information, including but not limited to: Name, Email address, Types of documents to be notarized: We may also collect other information related to the notary services you request, as required by law or necessary for service delivery. IE: Drivers License/State ID/Passport number, address. etc. Providing Services: We use the collected information to facilitate notary services as requested by you. Security Measures: We implement reasonable security measures to protect your information from unauthorized access, disclosure, alteration, or destruction. No Data Transmission Guarantees: While we take reasonable precautions, no data transmission over the internet or electronic storage method can be guaranteed to be 100% secure. Therefore, we cannot guarantee the absolute security of your information. 

5. Third-Party Services

Our website uses Google Analytics to collect data about website usage and improve our service offerings. You can opt-out of Google Analytics by using the Google Analytics Opt-out Browser Add-on. For payment processing, we use PayPal, and by making a payment through PayPal, you are also agreeing to their terms and privacy policy.

6. Use of Services

By using our notary services, you agree to:

  • Provide accurate and truthful information for the notarization of your documents.

  • Not submit fraudulent or misleading Identification and/or documents.

  • Abide by all applicable laws, including Michigan and Ohio notary laws.

7. User Conduct

You agree not to:

  • Use our services for illegal, unethical, or fraudulent activities.

  • Submit documents that are unlawful or prohibited under Michigan law.

  • Engage in behavior that disrupts or interferes with the functioning of the website or services.

8. Limitation of Liability​

To the fullest extent permitted by applicable law, https://sharpseal.wixsite.com/mioh will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services. We are not responsible for any errors, omissions, or delays in the notarization process or for any damages resulting from failure to follow instructions or improper use of the notarized documents. IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, Owners, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS. Sharp Seal Notary LLC is not responsible for the delay, loss, damage, replacement fees of any documents or packages shipped by a third party.

These Terms will be governed by and construed in accordance with the laws of the State of Michigan & Ohio. Any legal action or proceeding related to these Terms shall be conducted in the courts located within Michigan or Ohio, as applicable.

We reserve the right to modify or update these Terms at any time without notice. Any changes will be effective immediately upon posting the revised Terms on the website. It is your responsibility to review these Terms periodically to stay informed of any updates.

The names and personal information of people who contact me for notary services will not be shared or sold to outside parties. Clients will have their name and basic information regarding their notarial transactions recorded in an official notary journal that is not part of this website. Notary journal records are necessary to establish completion of a notarial act should it come into question. Entries within a notary journal may be shared to comply with legal inquiries seeking confirmation about a notarization

​You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, sub-contractors, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: You agree to hold Sharp Seal Notary LLC, and/or anyone working for or with said such  harmless and indemnify the business against any claims, losses, or damages arising from the notarization, or any other services provided by Sharp Seal Notary LLC, including but not limited to errors or omissions, rejection of documents, cancellations, or failed appointments In no event shall Sharp Seal Notary LLC, or its representatives be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our services, whether based on contract, tort, strict liability, or other legal theory.(1) use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties set forth in these Legal Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Services with whom you connected via the Services. 19.  Signer responsibilities:  It is the sole responsibility of signer's to produce current, valid, government issued ID for a notarization.  These responsibilities also include knowing which notarial certificate is to be included with the document(s), have the documents prepared and printed & assembled ahead of notary appointment.  The signer also acknowledges that they need to read the document and know if they require additional credible witnesses with valid ID. Signer's acknowledge that a notary public is not an attorney, cannot give advice or prepare documents. 

 

20. Apostille & Authentication policies: 

Quality Assurance: Your satisfaction is our top priority. In the rare case of a notary error—like a missing stamp or signature—we’ll correct the document at no extra cost. We handle every document with care to ensure it meets the strict requirements for Apostille processing.

 

Professional  Service: Our team is highly trained and certified, with extensive experience in handling Apostille services. We stay up-to-date on the latest requirements and procedures, ensuring that your documents are in capable hands. You can rely on us for a professional and efficient service.

 

Timelines for processing: We provide you with estimated timelines based on the current processes of the Issuing Authorities. While we do everything possible to meet these timelines, delays can occur due to factors like changes in procedures or increased workloads, or shipping delays at these authorities. We will keep you informed of any updates throughout the process.

 

Limitations of Liability: While we work diligently to ensure your documents are processed correctly, the final decision regarding document acceptance is made by government authorities, such as the Secretary of State. We cannot guarantee specific outcomes, as these decisions are beyond our control.

No Refunds Policy: To maintain upfront transparency, we want you to know that all sales and services related to Apostille & Authentication processing are final and non-refundable or transferrable. This includes the Apostille or Authentication service itself, translation services, secretary of state fees, shipping, and any related expenses or services. We believe in providing you with clear information upfront to avoid any miscommunications later.

 

Shipping Responsibility: We pride ourselves in taking great care in preparing your documents for shipment, but once they are given to the carrier, we are not responsible for any delays,  loss or damages that may occur during transit. We highly encourage selecting insured shipping to protect your important documents.

Mortgage/Loan Closings Debt settlements:  Sharp Seal Notary LLC, is a Certified Loan Signing Agent - Through National Notary Association.  We have been educated/certified for all loan signings with ZERO rejections from any loan signing company.  We pride ourselves in our knowledge and reputation -  We require pre-payment for any/any type all loans, line of credit, mortgages, refinance, 2nd mortgage, debt settlements, etc.  If the appointment for a loan closing is cancelled or rescheduled for any reason less than 24 hours it is non-refundable.
